An Act 537 Plan was created by a new sewer system engineer, hired by the Township and Lower Paxton Sewer
Authority and approved by the Commonwealth Court on June 13, 2002. This Plan introduced mini-basin “total
rehab” concept and included Wet Weather Treatment Facility in Beaver Creek, rehabilitation of infiltration and
inflow of storm water into the sanitary sewer system in Paxton Creek and Spring Creek, and allowed for ‘total
rehab of the system in its second phase.
According to the federal Environmental Protection Agency (EPA), infiltration and inflow problems adversely
affect an estimated 19,500 communities throughout the United States, and will cost over 10 billion dollars to
bring communities into compliance with SSO regulations (Lower Paxton Township Website, 2011).
When Lower Paxton Sewer Authority accepted responsibility for Harrisburg’s public sewer system, immediate
intensive measures in elimination of sanitary sewer overflow were needed. The Pennsylvania Department of
Environmental Protection (PA DEP) also required reduction the excessive infiltration and inflow of storm
water into the sanitary sewer system.
The program following the EPA and PA DEP guidelines and requirements began in 1995 and after four years
and 19 million dollars invested in system improvement, was adjusted. Approximately 12 million gallons per day
reduction of wet weather flows did not achieve the goal of eliminating all sanitary sewer overflows in accordance
with PA DEP requirements; and was adjusted by an Act 537 Plan.
